These Terms of Use (“Terms”) apply to your use of greaterstpeteagents.com (the “Site”), operated by Andre R. Aragon, Realtor®, and Molly Riddle, Realtor®, with Quicksilver Real Estate Group (“we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Using the Site

You may use the Site for your own personal, non-commercial purposes, such as researching homes and contacting us about buying or selling real estate. You agree not to:

  • Copy, scrape, harvest or download listing data, photos or other content using automated tools
  • Use the Site for any unlawful purpose or in a way that violates these Terms
  • Submit false information or information about another person without their permission
  • Interfere with the Site’s operation or security, or try to access areas you are not authorized to use
  • Use the Site to send spam or other unsolicited messages

We may change, suspend or stop any part of the Site at any time, and we may limit or end your access if you violate these Terms.

Estimates Are Not Appraisals, Guarantees or Offers

Every figure on the Site or that we send you, including any home value estimate, comparative market analysis, cash-at-closing estimate, cash offer comparison, price range or market statistic, is an estimate only. An estimate:

  • Is not an appraisal and should not be used in place of one
  • Is not a guarantee of a sale price, net proceeds, timeline or result
  • Is not an offer to buy your property or a commitment by anyone to make one

Estimates are based on available data and assumptions that may be incomplete or change. Actual results depend on the property’s condition, market conditions, the terms of any offer and other factors. Requesting an estimate is free and creates no obligation for you or for us.

Listing (IDX) and MLS Information

Property listing information on the Site is provided through Buying Buddy’s Internet Data Exchange (IDX) service, using data from Stellar MLS. Listing information is deemed reliable but is not guaranteed and should be independently verified. It may contain errors, may not be current, and listings may be sold, withdrawn or changed at any time. Square footage, lot size, school assignments, taxes and other details are approximate. Some properties shown may be listed by other brokerages. IDX information is provided only for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify properties you may be interested in buying.

Not Legal, Tax or Financial Advice

Information on the Site, including articles, guides, market updates and estimates, is general information only. It is not legal, tax, financial, lending, insurance or investment advice. Please talk with a licensed attorney, tax professional, lender or other qualified professional about your situation before making decisions.

No Agency Relationship From Using the Site

Using the Site, submitting a form or receiving information from us does not by itself create a brokerage or agency relationship. Any brokerage relationship, and any compensation, will be set out in a separate written agreement signed by you and Quicksilver Real Estate Group.

Text Message (SMS) Program Terms

Program description: If you check the optional text message box on one of our forms, you agree to receive text messages from Andre R. Aragon and Molly Riddle, Quicksilver Real Estate Group, at the mobile number you provided, about your real estate request. This may include replies to your questions, appointment scheduling and reminders, home value and market information, and listings you asked about. Some messages may be sent using automated technology.

  • Consent is optional. Consent to receive text messages is not a condition of any purchase or service, and you do not need to give it to submit a form or work with us.
  • Message frequency varies depending on your request and our conversation with you.

  • To opt out, reply STOP to any message. You will receive one message confirming you have opted out, and no further texts unless you opt in again.

Realtor® is a registered collective membership mark that identifies real estate professionals who are members of the National Association of Realtors® and follow its Code of Ethics. Other names and logos on the Site may be trademarks of their owners.

Third-Party Links and Services

The Site includes links to, and tools from, other companies. We do not control and are not responsible for their content, accuracy, availability or practices. Your use of them is subject to their own terms and policies.

Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, error-free or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent allowed by law, Andre R. Aragon, Molly Riddle, Quicksilver Real Estate Group, and their agents, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or opportunity, arising from or related to your use of, or inability to use, the Site or its content, even if we were told such damages were possible. Some laws do not allow these limits, so they may not fully apply to you.

Indemnification

You agree to defend and hold harmless Andre R. Aragon, Molly Riddle and Quicksilver Real Estate Group from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute related to the Site or these Terms will be brought in the state or federal courts located in Pinellas County, Florida, and you agree to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date above. Your continued use of the Site after a change means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about your use of the Site.
